Watch out employers! The DOL is cracking down on FMLA violations

Watch out employers! The Department of Labor is cracking down on FMLA violations. The DOL is taking on an increased number of cases as shown by the EEOC who initiated over 42% of the wage-and-hour investigations in 2015, a record high. 79% of these investigations found a violation and had an average of $8,900 paid in back wages to workers who had never even filed a complaint.  A recent case involving a Hotel and Casino in Las Vegas and a banquet server who complained to the DOL about being fired for taking FMLA leave. The case ended in the banquet server being reinstated to his job and receiving full back pay for the hours he would have worked and credit for his pension and health care. This totaled to $74,000.
