Parking Regulations

 Internal Revenue Service
Final regulation, effective January 11, 2001

SUMMARY: This document contains final regulations relating to qualified transportation fringe benefits. These final regulations provide rules to ensure that transportation benefits provided to employees are excludable from gross income. These final regulations reflect changes to the law made by the Energy Policy Act of 1992, the Taxpayer Relief Act of 1997, and the Transportation Equity Act for the 21st Century. These final regulations affect employers that offer qualified transportation fringes and employees who receive these benefits.

Summary of the Rules:

Section 132 provides for certain commuter-related parking  and transit expenses to be paid for on a pre-tax basis. Employee elections are payroll deducted and placed in a special reimbursement account. Participants may be reimbursed up to the total amount contributed through payroll deductions. Employees are permitted to make election changes throughout the plan period. The frequency for making changes is determined by the employer.

Reimbursements are only issued for eligible expenses incurred by the employee. Funds remaining in the account at the end of the plan period carry over into the next plan period.

The employer determines eligibility for this benefit (within discrimination requirements) and the maximum and minimum contributions as allowed by Section 132 regulations.

Income tax reporting is not required is this account.  The payroll deductions are free of federal, state and (in most cases) FICA taxes and do not even appear on a W-2 as reported income.
